Traps
A dark pattern makes you do something unintended by exploiting attention and defaults rather than by persuading. All three parts have to hold, and the term has stretched to cover any interface somebody disliked — which makes it useless. A prominent buy button is selling. A cancellation that requires a phone call during business hours is not.
The regulatory position is not what most coverage says. The FTC's click-to-cancel rule was finalised in October 2024 and vacated by the Eighth Circuit in July 2025 on procedural grounds. In March 2026 the Commission restarted rulemaking on negative-option marketing, and enforcement under general deception authority has continued throughout. Articles stating the rule is in force were written before the decision or without checking. Cancellation has seven common obstacles — hidden location, retention offer, reason survey, confirmshaming, pause offer, channel switch, and no confirmation. If you subscribed through an app store, all of them are bypassed by cancelling in device settings, which takes four taps and produces a confirmation.
Defences split into automatic and vigilance-dependent, and the second group fails, because the entire model assumes you will not remember. Ranked: cancel at subscription, a zero-limit virtual card, buying through a platform, a calendar reminder, watching statements. One habit removes most of this section. Cancel immediately after subscribing, where access runs to the end of the paid period anyway — you keep what you paid for, the renewal never happens, and every subscription becomes something you decide to keep rather than something you must remember to stop.
